This Privacy Policy explains how iBrushy (“we”, “us”, “our”), operated by ENLIGHTENMENT CLUB LLC, 30 N Gould St #39255, Sheridan, WY 82801, USA, collects, uses and discloses your personal information when you visit or buy from ibrushy.com (the “Site”), use our services or otherwise contact us (together, the “Services”). It also serves as our notice at collection under the California Consumer Privacy Act and other US state privacy laws, to the extent they apply to us.

1. Personal information we collect

In the past 12 months we have collected the following categories of personal information:

• Identifiers and contact details, such as name, address, phone number and email address.
• Commercial information, such as order information, purchase history, payment confirmation and customer support information.
• Account information, such as username, password, security questions and other information used for account security. Account log-in details are “sensitive personal information” under some state laws; we use them only to provide and secure your account.
• Internet or other network activity, such as device and browser information, network connection details, how you use the Site, and recordings of how you move, click and scroll on our pages (session replay and heatmaps) (“Usage Data”).
• Geolocation data, such as location derived from your IP address or other technical measures.

We collect this information directly from you, automatically through cookies, pixels and similar technologies, and from third parties such as Shopify and payment processors (which collect payment information to process payments and fulfill orders).

2. How we use personal information

• to provide the Services: processing payments, fulfilling and shipping orders, account notifications, managing your account, and handling returns and exchanges;
• for marketing and advertising, such as marketing emails or text messages and showing advertisements for our products;
• for security and fraud prevention;
• to provide customer support and improve the Services;
• to comply with the law, enforce our Terms of Service and protect our rights and those of our users and others.

Text messages: if you sign up for marketing text messages, message frequency varies and message and data rates may apply. Reply STOP to unsubscribe or HELP for help. Consent to receive marketing texts is not a condition of purchase. We do not share your text-message opt-in or consent records with third parties, other than the service providers that send our messages.

If you create an account, you are responsible for keeping your login details secure. We may also let Shopify link your account with other Shopify services you choose to use; Shopify then processes your information under its own Privacy Policy.

3. How we disclose personal information

• to vendors and service providers acting on our behalf (for example IT services, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping);
• to marketing and business partners, to provide services and advertise to you;
• to affiliates within our corporate group;
• when you direct us to, for example to ship products to you;
• in connection with a business transaction, such as a merger or bankruptcy, and where needed to comply with the law or to protect rights and safety.

We use sensitive personal information (your account log-in details) only to provide and secure your account, and we do not use it to infer characteristics about you.

Consumer health data: we sell skincare and body-care products and do not ask about your health. We do not use your browsing or purchases to infer any health condition. If you choose to tell us about a health condition, for example in a support email, we use it only to answer you, and you can ask us to delete it at any time by emailing info@ibrushy.com. Residents of Washington and Nevada can also use the rights in section 5 for any such information.

4. “Sale”, “sharing” and targeted advertising

In the past 12 months we have “sold” or “shared” (as those terms are defined by applicable law) the following personal information to advertising partners (such as Meta, Google and TikTok) and analytics providers (such as Google and Microsoft), for targeted advertising, marketing and analytics purposes:

• identifiers such as name, email address and phone number;
• commercial information such as records of products purchased;
• Usage Data.

We do not knowingly sell or share the personal information of consumers under 18, or use it for targeted advertising.

How to opt out: email info@ibrushy.com with the subject “Do not sell or share my personal information”. Within 15 business days we will apply your request to the personal information we can link to you, meaning your email address, phone number and customer account: we will stop including you in customer lists we upload to advertising platforms and stop sharing your contact and purchase details for targeted advertising. An email request cannot switch off the cookies and pixels that run in your browser. Our Site does not currently respond to browser “Do Not Track” or Global Privacy Control (GPC) signals, and choices made in our cookie banner or on our “Your Privacy Choices” page do not currently switch those technologies off. To limit browser-based tracking, block or delete cookies and site data for ibrushy.com in your browser settings or use a tracker-blocking extension.

5. Your privacy rights

Depending on the state where you live, you may have the right to:

• know and access the personal information we hold about you;
• delete your personal information;
• correct inaccurate personal information;
• receive a portable copy of your personal information;
• opt out of the sale or sharing of personal information and of targeted advertising;
• appeal our decision on your request.

To make a request, email info@ibrushy.com. We will verify your identity before responding and reply within the time required by law. You may use an authorized agent; we may ask for proof of the agent’s authority. If we decline your request, you can appeal by replying to our decision; if you disagree with the outcome of your appeal, you can contact the Attorney General of your state. We will not discriminate against you for exercising your rights.

Notice of financial incentive: when we offer a discount or other benefit for joining our email or text-message list, joining is voluntary: you opt in by entering your email address or phone number in the sign-up form, and you can withdraw at any time by unsubscribing or replying STOP. We offer these benefits because subscribers are more likely to buy from us; in good faith, we estimate the value of your email address or phone number to us as no more than the value of the benefit offered, based on our average revenue and marketing costs per subscriber.

6. Cookies

We and third parties use cookies, pixels, scripts and similar technologies on the Site to run the Site and checkout (Shopify), measure visits and sales (Shopify analytics and our own analytics tool), record browsing sessions and create heatmaps of how visitors move, click and scroll (Microsoft Clarity and our own heatmap tool), advertise our products and measure our ads (for example the Meta Pixel, Google Ads and Google Analytics, and the TikTok Pixel), manage email and text-message sign-ups (Klaviyo) and show product reviews (Judge.me). These technologies start when a page loads, and choices made in our cookie banner do not currently switch them off. Third parties such as Meta, Google, TikTok and Microsoft may collect personal information about your online activities over time and across different websites when you use our Site. As stated in section 4, our Site does not currently respond to Do Not Track signals. For the cookies used with Shopify, see shopify.com/legal/cookies. Most browsers accept cookies by default; you can set your browser to remove or reject them, which may affect how the Site works.

7. Retention and security

We keep each category of personal information only as long as we need it:

• identifiers, contact details and commercial information: order and payment records for 7 years after the end of the year of the order, for tax, accounting and legal claims; customer support emails for 3 years after our last contact with you;
• account information, including log-in details: while your account is open; we delete or de-identify it within 30 days after you close it, except order records;
• marketing contact details: until you unsubscribe, after which we keep your email address or phone number on a suppression list so that we do not contact you again;
• Usage Data and geolocation data from our own analytics and heatmap tools: up to 26 months; data collected through our Site by third parties such as Meta, Google, TikTok and Microsoft is kept under their own retention policies.

No security measure is perfect and we cannot guarantee absolute security.

8. Children

The Services are intended for adults. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of anyone under 18 or use it for targeted advertising. If you believe a child has given us personal information, contact us and we will delete it.

9. International users

Your personal information may be transferred to, stored in and processed in countries other than the one where you live, by our staff and by our service providers and partners.

10. Third-party websites

The Site may link to third-party websites. We are not responsible for their privacy or security practices; please read their policies.

11. Changes to this policy

We may update this policy from time to time. We will post the new version on the Site, update the “Last updated” date and take any other steps required by law.
